ACLU Criticizes Obama, Holder Over Miranda Rights Proposal

In the wake of the attempted bombing in New York City’s Times Square earlier this month there have been signals from the Obama administration that it would seek a new law to loosen the requirement that terrorism suspects be informed of their constitutional rights during interrogation.
Attorney General Eric Holder alluded to this during a string of appearances on network news shows on Sunday morning, and it has civil and human rights defenders up in arms.
For example, the nation’s top civil rights organization, the American Civil Liberties Union (ACLU), said the proposal, if it became legislation, would undermine the Miranda requirement that was ruled to be a constitutional right by the United States Supreme Court.
Director of the ACLU Washington Legislative Office Laura W. Murphy expressed her disappointment at what she saw was Holder’s suggestion that Americans should choose between their freedoms and security.
Jameel Jaffer, deputy legal director of the ACLU, added that "legislation that significantly undermined Miranda would be unconstitutional, as Mr. Holder should know as well as anyone. The Miranda requirement is rooted in the Fifth Amendment."
On May 1, Faisal Shahzad, a U.S. citizen of Pakistani descent, allegedly tried to blow up a car packed with explosives in the middle of Times Square in New York City. The attempt was unsuccessful and Shahzad was apprehended two days later as he was trying to leave the country on a a flight from JFK airport to Dubai.

School pulls student art after complaints
A painting depicting President Barack Obama next to a hammer and sickle symbol hung for nearly two weeks at Hallsville High School. It was taken down Monday after complaints.

HALLSVILLE — Art teacher Brittany Williamson said her student simply wanted to “get a reaction” with his painting that depicted President Barack Obama with a hammer and sickle symbolizing communism.
“That’s the whole purpose of art — to get a reaction,” Williamson said.
Although Williamson thought the Hallsville High School sophomore’s painting was “an amazing piece,” it received not-so-amazing critiques from some school staff and visitors who complained to Williamson and Superintendent John Robertson. The painting was taken down Monday after being displayed for nearly two weeks.
Robertson said the piece was removed because it could have been construed to reflect an official position of the school district.
“The district really can’t express political views,” Robertson said, explaining that he talked to Williamson and the student about the issue. “I told him as an artist he certainly has the right to express his opinions but we didn’t have to hang it up.”
Williamson said she did not want the student to remove the artwork but that other teachers had asked her to take it down. The student has since taken the painting home.
Robertson said if the painting had been a part of a display that was politically themed, “that would be a whole, total different thing.”
“It was the only” political “piece that was up,” Williamson said, “so it made it look like the school felt that way.”
Williamson said the student artist — whom the school would not identify — “took it upon himself” to tape the painting to a window of the school’s copy room.
“No matter how I feel toward President Obama, it’s an amazing piece for a high school student,” she said. Williamson said her student “always seems to do something right on the edge.”
Supreme Court rulings seem to side with the school district on whether to abridge a student’s First Amendment right to freedom of expression.
Doug Abrams, an associate professor at the University of Missouri School of Law, said the courts have determined that students have First Amendment rights, “but if the administration believes that exercise of those rights would disrupt the school’s learning environment, then the administration can abridge the exercise of those rights.”
Abrams gave the example of national news reports about students being sent home from school for wearing jackets or T-shirts bearing the Confederate flag.
“Whether you agree with it or disagree with it, it’s fair to say it’s political speech,” Abrams said. “Yes, students have free speech, but it’s less than what people would have out on the street.”
Williamson has taught art at Hallsville High School for eight years. Even though she was disappointed that the painting was taken down, she said the issue served as “a good learning experience” for staff and students. Some students, she said, didn’t understand why the symbol was controversial.
“Everyone was like, ‘Why is it so wrong? Because it’s pink?’ ” Williamson said of the painting. “I think even some adults didn’t understand it.”

* A bi-racial man who derided his grandmother (a bank-executive who sent him to an exclusive private school), calling her "a typical white person."
* A man who arrived in New York in June of 1981 without enough money to get a hotel room, but one month later flew to Indonesia and Pakistan.
* Why did he go?
* Who paid his expenses?
* A man who traveled to Pakistan when it was illegal for U.S. citizens to do so. So what country’s passport did he use? And what country is he really a citizen of?—it's not the USA.
* A man whose Law School Admission Test scores and grades at Columbia University are known to have been mediocre, but was admitted to Harvard Law School through the intervention of a Saudi named Khalid al -Mansour.
* A law review editor who never published an article in any law review.
*A law-school grad who was turned down for a lowly job as an adjunct instructor, but who was then given a corner office and a minimal teaching load (one intro course) when an unidentified person leaned on the Dean.
*An adjunct instructor who was despised by the law school faculty—the professors considered him lazy and stupid—but who is lauded by the fawning press as a "Constitutional scholar."
* A man who has publicly called the US Constitution "fundamentally flawed."
* A lawyer with no significant accomplishments in the law and no reputation in the legal community.
* A former State and U.S. Senator, who authored just one piece of legislation—which funded the Marxist campaign of his Kenyan cousin, Odingo.
* A former State Senator who routinely used State limosines as a place to smoke crack cocaine and engage in homosexual acts with young men, three of whom ended up shot in the back of the head (officially deemed "suicides").
* A disciple of the Marxist Saul Alinsky.

* A man who speaks endlessly about helping the less fortunate, but gives almost none of his sizeable income to charity—not even to his half-brother, who is living in squalor in Kenya.
* A man who had the most left-wing voting record in the United State Senate, but was predicted by the press to “govern from the middle.”
* A man who has never created a job, met a payroll, or even operated a lemonade stand, but wants to tell Detroit how to make cars.
*A man whose wife (who attained a position of affluence through affirmative action) publicly proclaimed that she had never been proud of America until her husband became President.
* A President who has never before served as an executive in either the private or the public sector.
* A Commander-in-Chief who doesn’t know how to shoot a rifle, throw a hand-grenade, drive a tank, fly a plane, or con a ship.
* A Commander-in-Chief who has publicly divulged some of our nation’s most important intelligence secrets.
* A man who has been put in charge of the largest economic engine that ever existed, but has never invested in the stock market and admits total ignorance of it.
* A President who says that science will guide his administration, but has no education in the sciences.
* A man praised for his public speaking skills who is proficient in reading what is written for him on a teleprompter, but who jerks and stammers his way through any off-the-cuff speaking.
* A man who requires a teleprompter in order to be able to speak for five minutes to a class of kindergartners.
* A man whose health records are sealed from childhood to the present day.
* A man who spent 20 years in a church whose pastor espouses Marxist Liberation Theology, anti-Americanism, anti-capitalism, and anti-Semitism, but claims he never heard his pastor utter anti-American, and anti-Semitic statements.
* A man who added more to the National Debt in 120 days than all other Presidents did in the past 220 years, yet feels qualified to lecture Americans about “fiscal responsibility.”
* A man who publicly expressed disdain for the U.S. Constitution on a Chicago radio station because it limited the government’s ability to “redistribute wealth.”
* A man who sits and listens submissively while his country is castigated by Daniel Ortega—a Communist thug whose own daughter accused him of raping her.
* A narcissist who gave the Queen of England a present from the United States—an iPod containing recordings of his own speeches.
* A so-called Christian who officially declared “Pride Month” for a lifestyle that the Bible calls an abomination.
* A man who wanted Americans to ignore his Muslim name during his election campaign, yet boasts of his Muslim name when he travels to Muslim countries.
* A man who can name hundreds of America’s shortcomings, yet none of its great accomplishments.
* A President who claims the moral high ground by closing Gitmo yet supports the transfer of terror suspects to countries where horrific torture is certain.
* A President who scoffed at being called a socialist yet acted to nationalize the auto industry, the banking industry, and the insurance industry . . . and now seeks to nationalize the healthcare industry.
* A President who violates private property rights, the sanctity of contracts, and the rule of law—three essential principles that go back over a thousand years in the Common Law tradition.
* A man who promised 95% of all Americans a tax cut, but is increasing taxes on 100% of the population through inflation—the cruelest tax of all.
* A lawyer who represented ACORN—an organization now indicted in several states for voter fraud—whose stated goal is to get as many people on welfare as possible in order to destroy our financial system.
* A President who cheated GM’s bondholders by giving their property to the UAW in a political payoff.
* An American President who frequently criticizes his own country when speaking in foreign countries, but never praises America’s generosity, goodness or greatness.
* A President whose Secretary of the Treasury cheated on his taxes—as did several other appointees and advisors.
* A President who scoffs at being called a socialist, yet has appointed 28 “Czars” to circumvent constitutional government, including: a“Science Czar” who has advocated compulsory abortions for American women and the “surrender of sovereignty” to a “comprehensive Planetary Regime;" a“Green Jobs Czar” who is a self-professed communist; a "Pay Czar” to unconstitutionally micro-manage the pay of corporate executives.
* A President who swore an oath to “preserve, protect and defend the constitution from all enemies, foreign and domestic,” yet who placed a domestic enemy of the Constitution (Sotomayor) to the Supreme Court.
* A President whose Homeland Security Chief classified pro-lifers, veterans, and supporters of traditional marriage as terrorists.
* A President who stood silent while the Iranian government hacked unarmed protestors to death with axes, because it was an internal matter, but freely offers his opinions about the internal affairs of Israel and Honduras.
* A President who decreed that true acts of terrorism must now be described as “man-made disasters.”
* A President who, on national television, called Special Olympians "retards."
* A President who refused to intercept or inspect a North Korean ship virtually certain to be carrying Weapons of Mass Destruction to Burma.
* A President who wants to cancel all missile defenses while rogue nations are developing long-range ballistic missiles.
* An American President who blames the violence in Mexico on America.
* A Commander in Chief who claims to have been unaware that Air Force One was taken on a terrifying, low-level photo-op over Manhattan.
* A President who berates American CEO’s for flying in private planes at private expense on company business, but whose wife spends hundreds of thousands tax payer dollars flying to Paris for shopping sprees.
* A President who promised a transparent administration, but requires all questions be screened before “impromptu” appearances.
* A man who freely admitted that his energy policies are designed to bankrupt the American coal industry.
* A President who has presided over the loss of 14.7 million jobs and whose “energy policy” will cause the loss of another 1 million jobs.
* A President whose “energy policy” will increase the average American’s utility bills by over $2,000 a year in the middle of the Great Recession.
* A President whose caucus rammed through unconstitutional “healthcare reform” which nationalizes almost one-fifth of the Americn economy.
* A President who is by definition a fascist, as his unconstitutional takeover of the healthcare industry, the auto industry, and the the financial and banking industry, has effectively nationalized one-half of the American economy.
SOMEONE KNOWS:
The vast majority of Americans do not know who he is, but someone surely does.
* Someone paid for his travel expenses to Pakistan and Indonesia.
* Someone engineered legal challenges to all of his election opponents for the State Senate and had them disqualified.
* Someone straightened and leveled his path to the U.S. Senate when a Democrat Judge made public the sealed child custody records of his Republican opponent. When he was a candidate for the U.S. Senate, someone arranged for him to speak at the 2004 Democratic National Convention.
* Someone saw to it that all of his records were sealed, both at home and abroad. Someone assembled the massive organization for his run for the Presidency. Someone knows all about him.

If illegals spent $10 each, with a tax rate of 10%, we could buy 100
foreclosed to put American families in!

they would stop other people getting an amendment. And that was on
both the Democratic side and the Republican side," Reid said.

MORE OF KAREN HANDEL'S BROKEN PROMISES...
I ask you to pray for the state of GA and the leaders that you're
choosing to represent this great state:
Last year, I went to a training session to become a lobbyist, and I
went to a Republican meeting for Karen Handel. After meeting her, I
tried to address the issues of corruption in Clayton County by writing
the Governor. While she should've been holding Clayton County
accountable all along as Secretary of State, she was padding Perdue's
numbers until Clayton County's looming budget problems were placing a
strain on the state budget. When Perdue confronted her by cutting her
budget, she resigned.
I initially went to the military about Clayton County's proliferate
drug problems, as CCPD and HCPD were no help in 2006-2009, so the
military contacted the FBI. Both CCPD and HCPD violated my Habeas
corpus by not following proper arrest procedures and protocol:
The FBI led an inquiry into the former Administration of Victor Hill
and into then Chief of Police Jeff Turner for evidence tampering, and
an evidence back log of drugs and weaponry that would make Manuel
Noriega proud!

Panamanian politician and soldier. He was military dictator of Panama
from 1983 to 1989.[3]
The 1989 invasion of Panama by the United States removed him from
power; he was captured, detained as a prisoner of war, and flown to
the United States. Noriega was tried on eight counts of drug
trafficking, racketeering, and money laundering in April 1992.
Noriega's U.S. prison sentence ended in September 2007;[4] pending the
outcome of extradition requests by both Panama and France. France was
granted its extradition request in April 2010, and the former dictator
arrived in Paris on April 27, 2010.[5])
While the wild stallion operation under Victor Hill was flourishing, I
was an undercover journalist waiting tables and trying to get a better
job when I was made aware that former Sheriff Victor Hill was
contracting with criminals: asking them to run drugs for time off
their sentences and turning people in for drug cell cases; without
paying undercover officers or properly involving the GBI or FBI for
these operations instead. *This is an unethical practice which makes
uncontaminated illegal drugs readily available to the public, and
while it was lucrative, Karen Handel and Attorney General Thurbert
Baker turned a blind eye to the whole thing until Victor Hill had not
turned in county funds, when Gibson suspected $1.5 million was being
shuffled around in a day trading scheme --- essentially, Hill was
collecting illegal drug revenue from his goons and taking Clayton
County's taxpayer dollars and gambling it away in the stock market!
None of this surfaced until I had written Victor Hill a letter, saying
that the Harold Banke Justice Complex would be issued citations for
operating against state standards, for which it is a private facility
that receives state funding. He was neglecting the facility and its
proper operating procedures. Facing a losing re-election, he declared
bankruptcy, sticking Clayton County taxpayers with the tab for his
misappropriation and leaving the Council one heck of a mess to clean
up, including $60,000 worth of boiler equipment for the facility! If
it wasn't for Eldrin Bell's insistence that integrity be maintained,
the truth may have never made it through all of the proper channels!
As a result of my perseverance, and despite being incarcerated after
being threatened by one of Hill's goons, Hill had the goon beaten
nearly to death in his own home when I pled not guilty and refused to
have the goon's lawyer represent me, Maccione.
*HCPD's office fired my lawyer, and because of the delays, I didn't
have a trial within 90days of indictment, so I essentially did the
time for the charge as if I were guilty before even having the matter
heard!! Judge Crumbley was kind enough to hear the case, saying that I
could retry it within 3yrs., but with the subsequent FBI involvement,
the investigation isn't complete still, and Perdue told me to approach
Superior Court with this matter, as Superior Court issued the order
for $12 million in drugs to be burned:

JONESBORO, Ga. -- Clayton County police say they've burned more than
$12 million worth of drugs that had accumulated in their evidence
room.
The Atlanta Journal-Constitution reports County police spokeswoman Lt.
Tina Daniel says police received a court order from a Superior Court
judge to allow them to burn nearly 10,000 pounds of marijuana, crystal
meth and other drugs. Daniel says the action came in response to a
recent audit of the department.
In criticizing former Police Chief Jeff Turner's management of the
department, county Chief of Staff Alex Cohilas described the narcotics
evidence room as being "in shambles."
The burn was done with the aid of the Clayton Fire and Emergency
Services, the Clayton County Sheriff's Office and the Clayton County
District Attorney's Office.

I would like to say that being a personal accountant for Perdue doth
not a Secretary of State make! While I believe that Victor Hill is now
running for Senate to avoid being arrested and charged with
misappropriation, you plainly see that former Secretary of State Karen
Handel and Attorney General Thurbert Baker have failed to charge him
with misappropriation and defrauding a public office.... say did y'all
bother to ask him about the rest of those fake badges that he issued
when he declared that he would run?!
*At least Perdue has heard our concerns about the health care bill
along with the petitions of Deal and Scott, with other matters and
relevant legislation, to which he could've just as easily and lazily

Public office is a test of character in itself.

warring against powers and principalities, not just politics and

Obama's 'gay' problem

The California decision against the same-sex marriage ban has the candidates for the presidency declaring their dedication to the traditional definition of marriage. Even the faux conservative, John McCain, meekly defended a "difference of opinion" on marriage during an appearance on lesbian bride-to-be Ellen Degeneres' national talk show.
Suddenly, it's back to basics since only a small minority of Americans are interested in allowing woman and woman to become wife and wife. Even liberal California, a state that's not sure which flag to salute, rejected gay marriage by 60 percent. In 2004, the debate over marriage may have ruined the John Kerry candidacy, but my bet is that Americans were more offended by the amount of hairspray running mate John Edwards applied to his coif.
From sea to shinning sea, Americans have defined marriage as between man and woman; whether in Alabama or Alaska, it's safe to say transsexual nuptials are politically toxic. Although every candidate quickly came out against gay marriage, Democrats are the most vulnerable to the accusations of being closeted activist. When it comes to the "marriage equality" agenda, the man who calls himself "the most consistent advocate on LGBT issues" is particularly suspect.
Like a staph infection resistant to aggressive antibiotics, Barack Obama has a gay problem that will keep returning if only the American media will recognize and examine the symptoms.

The history between Obama and the LGBT movement goes way back. The Barack Obama for President campaign got early seed money from billionaire, gay activist and entertainment executive David Geffen. Geffen gave Obama the pink thumbs-up after banishing the Clintons from Tinseltown.
"Everybody in politics lies, but [the Clintons] do it with such ease, it's troubling," said Geffen before anointing Obama and placing the world's most sophisticated propaganda industry at the disposal of the "Hope" and "Change" campaign.
The honeymoon did not last. Obama ruffled LGBT sensitivities when an ex-gay gospel singer headlined during the early days of Obama's presidential run. Gay activists protested to have the singer removed from the campaign.

The peddlers of pride, diversity, free speech, tolerance and fairness in the workplace wanted the singing black guy fired for disagreeing with them. If that sounds as inconsistent as the vows of two men publicly promising to be monogamous to one another, don't worry; none of this stuff is supposed to make sense, especially for the first serious biracial contender to the White House.
Ever notice the LGBT advocates constantly compare the same-sex struggle to the civil rights movement? According to polls, African-Americans are the most opposed to the legalization of gay marriage, and no black leader has endorsed the comparison between racial equality and the "right" for pre-op transsexuals to get a taxpayer funded sex change. The liberal interpretation of the civil rights struggle through the rainbow-colored glasses of the "queer theory" activist would have given the Rev. Martin Luther King a nightmare, rather than a dream.
"The transgendered community has to be protected. I just don't have any tolerance for that sort of intolerance. And I think we need to legislate aggressively to protect them," Obama told the Advocate, the modern day Pravda of the pink triangle set.
The Obama platform calls for the repeal of the Defense of Marriage Act signed into law by President Clinton. The law protects one state from imposing its definition of marriage onto another state – the same way gay advocates would like to impose a new definition onto how the Department of Defense keeps statistics.
"I reasonably can see 'don't ask, don't tell' eliminated," Obama said.
Eliminating "don't ask, don't tell" is an invitation to give priority to the self-serving activism of "out and proud" over the self-sacrificing commitment of "just doing my job."
We don't classify soldiers as Democrats, conservatives, Republicans or liberals, but activists would like those who fall in the line of duty to be recognized by who and what turns them on.
Obama's gay agenda is based on mainstreaming the marginal, but the senator is both methodical and pragmatic. In regards to transgender inclusiveness: "I've also been honest with the groups that I've met with that it is a heavy lift through Congress." Obama would eventually like for the transgendered to serve openly in the military too, but he's willing to wait.
When asked why so many African-Americans are opposed to the gay agenda, Obama replied, "Most African-American churches are still fairly traditional in their interpretations of Scripture." Obama does have queer religious beliefs – the church where attendees applauded "God d--- America" has happily blessed same-sex civil unions for years.

WASHINGTON (CNN) -- President Obama delivered a rousing speech Saturday night to the nation's largest gay rights group, praising the gay community for making strides in equal rights and pledging to deliver on major campaign promises that some say he's left on the back burner.

"For nearly 30 years, you've advocated for those without a voice," Obama said during his address at the dinner for the Human Rights Campaign. "Despite the progress we've made, there are still laws to change and hearts to open."
Obama's speech came as gay rights activists continued to lose patience over the lack of change to key issues for the gay community -- including the Pentagon's "don't ask, don't tell" policy. It comes on the eve of a major gays-rights rally in Washington.
"This fight continues now and I'm here with the simple message: I'm here with you in that fight," Obama told the applauding crowd.
The Human Rights Campaign issued a statement praising the speech, saying it was a "historic night when we felt the full embrace and commitment of the president of the United States. It's simply unprecedented."
Obama called for the repeal of the ban on gays in the military -- the "don't ask, don't tell" policy.
"We should not be punishing patriotic Americans who have stepped forward to serve this country," he said. "I'm working with the Pentagon, its leadership and the members of the House and Senate on ending this policy, legislation that has been introduced in the House to make this happen, I will end 'don't ask, don't tell.' That's my commitment to you."
The president said he backed the rights of gay couples, saying they should have the "same rights and responsibilities afforded to any married couple in this country." He said he has urged Congress to repeal the Defense of Marriage Act and to pass the Domestic Partners Benefit and Obligations Act.

Obama also touched on protection against hate crimes, noting that legislation was passed in the House this week that expanded the definition of hate crimes to include attacks based on sexual orientation and gender identity.
"I can announce that after more than a decade, this bill is set to pass and I will sign it into law," he said.
Obama acknowledged the fact that many in the gay community don't believe government is moving fast enough to address their concerns.
"Many of you don't believe progress is happening. I want to be honest about that because it's important to be honest among friends," he said. "I said this before, I'll repeat it again, it's not important for me to tell you to be patient."
Obama said gay people, like other Americans, are affected by myriad concerns -- namely, the economy and the wars in Afghanistan and Iraq -- and stressed that he's focusing on issues that affect the entire nation.

"While some may wish to define you solely by your sexual orientation or identity alone, you know and I know that none of us want to be defined by one part of what makes us whole," he said. "So I know you want me working on jobs and the economy and all of the other issues that we're dealing with."
Still, Obama said, it's imperative that the gay community continue to pursue the policies they support.
"It's so important that you continue to speak out and you continue to set an example and that you continue to press your leaders, including me, and to make the case all across America," he said.
The Human Rights Campaign in its statement praised Obama's pledge that "we will see a time in which we as a nation finally recognize the relationships between two men or two women."
The group said Obama "made it crystal clear that he is our strongest ally in this fight, that he understands and, in fact, encourages our activism and our voice even when we're impatient with the pace of change."

Forty years ago, patrons and supporters of the Stonewall Inn in New York City resisted police harassment that had become all too common for members of the lesbian, gay, bisexual, and transgender (LGBT) community. Out of this resistance, the LGBT rights movement in America was born. During LGBT Pride Month, we commemorate the events of June 1969 and commit to achieving equal justice under law for LGBT Americans.
LGBT Americans have made, and continue to make, great and lasting contributions that continue to strengthen the fabric of American society. There are many well-respected LGBT leaders in all professional fields, including the arts and business communities. LGBT Americans also mobilized the Nation to respond to the domestic HIV/AIDS epidemic and have played a vital role in broadening this country's response to the HIV pandemic.
Due in no small part to the determination and dedication of the LGBT rights movement, more LGBT Americans are living their lives openly today than ever before. I am proud to be the first President to appoint openly LGBT candidates to Senate-confirmed positions in the first 100 days of an Administration. These individuals embody the best qualities we seek in public servants, and across my Administration -- in both the White House and the Federal agencies -- openly LGBT employees are doing their jobs with distinction and professionalism.
The LGBT rights movement has achieved great progress, but there is more work to be done. LGBT youth should feel safe to learn without the fear of harassment, and LGBT families and seniors should be allowed to live their lives with dignity and respect.
My Administration has partnered with the LGBT community to advance a wide range of initiatives. At the international level, I have joined efforts at the United Nations to decriminalize homosexuality around the world. Here at home, I continue to support measures to bring the full spectrum of equal rights to LGBT Americans. These measures include enhancing hate crimes laws, supporting civil unions and Federal rights for LGBT couples, outlawing discrimination in the workplace, ensuring adoption rights, and ending the existing "Don't Ask, Don't Tell" policy in a way that strengthens our Armed Forces and our national security. We must also commit ourselves to fighting the HIV/AIDS epidemic by both reducing the number of HIV infections and providing care and support services to people living with HIV/AIDS across the United States.
These issues affect not only the LGBT community, but also our entire Nation. As long as the promise of equality for all remains unfulfilled, all Americans are affected. If we can work together to advance the principles upon which our Nation was founded, every American will benefit. During LGBT Pride Month, I call upon the LGBT community, the Congress, and the American people to work together to promote equal rights for all, regardless of sexual orientation or gender identity.

For all of Goldman Sachs' professed support for an overhaul of financial regulations, the megabank hasn't exactly withdrawn its army of lobbyists. Far from wearing out its welcome, the firm is busier than ever safeguarding its interests while a Wall Street crackdown takes shape in Washington.
Goldman has an unrivaled and influential network of lobbyists, including about 50 people with close ties to Congress and past White Houses, a Huffington Post Investigative Fund analysis of lobbying and campaign records shows. The lobbyists are challenging reforms aimed at Goldman's profit centers, including the trading of complex contracts known as derivatives. The Senate this week will continue debating proposed regulations of derivatives, which are blamed for fueling the financial crisis.
Perceptions of Goldman's role in the crisis, along with a civil fraud case brought against the bank last month by the Securities and Exchange Commission, have already spurred predictions of a less dominant future. But all is not lost for Goldman, which still stands out as perhaps the most influential of the nation's top six banks -- a remarkable feat given a crowded field of well-connected institutions.
Goldman's professional persuaders hail from 14 different lobbying firms, Senate lobbying records show. No other top bank -- not JPMorgan Chase & Co., Bank of America, Morgan Stanley, Wells Fargo or Citigroup -- has as many firms lobbying on its behalf. Goldman has hired nearly 40 lobbyists, all former government employees, to target financial reform alone, Senate disclosure records show.
These services have not come cheaply. Since the beginning of 2009, Goldman has spent nearly $6 million on lobbying, according to the nonpartisan Center for Responsive Politics. Only Citigroup and JPMorgan spent more.
So far this year, Goldman has revved up its lobbying even further. In the first three months of 2010, the bank spent $1.53 million lobbying, a 22 percent jump over the same period last year. Goldman also has increased its donations to political campaigns.
"It does show how a corporation will leave no stone unturned -- creating a powerful and potentially influential lobbying force," said Ellen Miller, co-founder and executive director of the Sunlight Foundation, a Washington-based nonprofit organization that advocates for greater disclosure of how Washington works and is influenced.
To be sure, Goldman isn't the only investment bank with a sophisticated lobbying operation, and pro-financial reform groups have attacked them all. Last week, three liberal advocacy groups said they had tallied the amount of money big banks are spending to influence financial reform: An estimated $600 million on lobbying and political campaign contributions since the government bailed out Bear Stearns in March 2008, and a lobbying force of more than 240 former government officials and Capitol Hill staffers. (Labor groups today will take to the lobbying industry's venerable K Street corridor in Washington to protest the prominent role lobbyists are playing in the financial reform debate.)
Most of Goldman's lobbying is done through an internal firm, The Goldman Sachs Group.
Leading the group is Michael Paese, who was deputy staff director of the House Financial Services Committee until September 2008. Rep. Barney Frank (D-Mass.), chairman of the committee, has prohibited Paese from lobbying the committee for two years. He did so to prevent Paese from influencing the House's Wall Street reform bill, which Frank largely crafted. Paese can still lobby other lawmakers, the White House and government agencies.
Paese and his group have indeed cast a wide net, lobbying the House, the Senate, the SEC and the Commodity Futures Trading Commission, records examined by the Investigative Fund show. Last year, in the wake of the financial crisis, the group zeroed in on Congress' impending overhaul of Wall Street. They lobbied on financial reform issues each quarter, records show.
A Goldman spokeswoman declined to comment for this story and several Goldman lobbyists did not return calls seeking comment. Without speaking to the lobbyists, it can be hard to tell exactly what they are arguing for or where they stand, because of the vagueness of lobbying disclosure reports.
Public statements suggest that, on the face of it, Goldman appears to support reform. "I think, on the whole, financial reform is absolutely essential," Goldman's Chief Executive Lloyd Blankfein told the Senate Permanent Subcommittee on Investigations last month. "America will be a big beneficiary" from reform, he predicted, though he added, "we will as well."
But some congressional staffers note that big banks are vigorously opposed to reforming their profit-making ways.
The legislation is "especially tough on Wall Street," said Steve Adamske, a spokesman for the financial services committee. "They've all come to talk to us, and none of them like the bill."
Financial reform legislation, in particular some proposed regulations of derivatives, could hit Goldman especially hard.
Derivatives protect companies from the risks of investing in stocks, commodities and mortgage-related securities, among other items. In the lead up to the 2008 financial collapse, Goldman would sometimes sell risky mortgage-related securities to investors, use derivatives to bet that the securities would fail and profit when they did.
At the hearing last month, Blankfein said he supported new derivatives rules, which for the first time would bring much of the $600 trillion private market onto regulated exchanges and clearinghouses.
"While derivatives are an important tool to help companies and financial institutions manage their risk, we need more transparency for the public and regulators as well as safeguards in the system for their use," Blankfein said.
But Senate disclosure records show that Goldman's lobbyists have paid close attention to proposed derivatives regulations during the past year. After all, the bank could lose 41 percent of its profits if the new derivatives regulations pass, according to a new report by Bernstein Research.
One controversial provision in the bill would prohibit banks from trading derivatives altogether, which could cost Goldman billions of dollars in revenue. The plan would force banks to spin off their derivatives trading into separate entities. This idea came from Sen. Blanche Lincoln (D-Ark.), chairwoman of the Senate Agricultural Committee, which passed a derivatives reform bill last month.
Goldman executives and lobbyists met with Lincoln last month to voice their objection to her proposal, according to news reports. Goldman also planned to host a campaign fundraiser in New York for Lincoln, who is facing a fierce primary challenge Tuesday. After the SEC filed its fraud case against Goldman, Lincoln canceled the fundraiser and said she wouldn't take any more cash from the bank. Goldman executives and the bank's political action committee have given about $2.4 million to federal candidates during the last two years, according to the Center for Responsive Politics.
Meanwhile, Goldman's arsenal of lobbyists -- a collection of former White House staffers, SEC employees and congressional committee aides -- has provided the bank with direct access to lawmakers.
Paese answers to Faryar Shirzad, head of global government affairs for the Goldman Sachs Group. Shirzad was a top economic and national security aide to President George W. Bush. The group also employs Ken Connolly, a former staff director for the Senate Environment and Public Works Committee; Joyce Brayboy, a former chief of staff for Rep. Melvin Watt (D-N.C.); and Joe Wall, a former deputy assistant for legislative affairs under former Vice President Dick Cheney.
Goldman also hired 13 outside lobbying firms, according to Senate lobbying disclosure forms. These lobbyists include former House Majority Leader Richard Gephardt; Stephen Elmendorf, Gephardt's former adviser; Ken Duberstien, former chief of staff to President Ronald Reagan; and Janice O'Connell, former adviser to Sen. Chris Dodd (D-Conn.), chairman of the Senate Banking Committee. Goldman also has tapped Harold Ford Sr., a former Democratic congressman from Tennessee and Daniel Meyer, former chief of staff to then-Speaker of the House Newt Gingrich.
The bank, once nicknamed "Government Sachs," has a long tradition of swapping employees with the federal government, including Treasury Secretaries Henry Paulson and Robert Rubin. Elena Kagan, the U.S. solicitor general and recent nominee to the Supreme Court, served on a Goldman advisory council from 2005 to 2008.
Goldman has also gained influence by hiring a series of Washington insiders who technically aren't lobbyists. In April, Goldman hired communications specialist Mark Fabiani, known as the "Master of Disaster" for his handling of public relations crises. The bank also hired veteran New York Times reporter Stephen Labaton, who wrote about regulatory issues. Labaton, who also is a lawyer, serves as a full-time consultant and reports to Blankfein.
Although Goldman's influence troops have largely focused on banking issues, the bank has also lobbied the House and Senate over transportation infrastructure legislation and renewable energy tax incentives for wind and solar power.
Goldman's lobbyists last year also aimed to influence the Treasury Department as it decided whether to allow the bank to pay back $10 billion in bailout funds received in 2008. In April of last year, the bank paid back the money in order to shake off compensation and hiring restrictions imposed on banks that took government aid. The bank expressed its "disapproval" of these restrictions, according to last year's lobbying records.
Goldman's more immediate concern, meanwhile, is the SEC's accusations of fraud and potential criminal charges that could ensue from that case.
In response to the commission's accusations, Goldman is beefing up its legal team. The megabank is projected to hire Paul, Weiss, Rifkind, Wharton & Garrison, a prominent corporate law firm, according to a Financial Times report. An SEC spokesman said he could not comment if Goldman, after hearing about the civil fraud investigation, dispatched lobbyists to dissuade the commission from pursuing the case.
